Understanding Tax Relief Options in 2026
Installment agreement, CNC, OIC, penalty abatement, and bankruptcy — when each one is the right tool.
“Tax relief” is a marketing phrase. The Internal Revenue Code has a short list of collection alternatives. Matching the file to the tool is the whole job. Selling every caller an Offer in Compromise is how the industry earned its reputation.
The menu
- Full pay / short-term (up to 180 days): best economics. Use it if a 401(k) loan or family help is cheaper than years of interest.
- Installment agreement: the default for people who can pay over time. Streamlined up to $50,000 for many individual income-tax cases. Payroll (trust fund) debt is tighter.
- Partial-pay installment agreement: monthly payment that will not finish the balance before the collection statute. The IRS wants assets addressed first.
- Currently Not Collectible: hardship. No levy, still accruing, reviewed when income appears on a new information return.
- Offer in Compromise: pay what the formula says you can pay, not what feels fair. Equity in a house you intend to keep is usually fatal to a low offer.
- Penalty abatement: first-time or reasonable cause. Often stacked with an IA.
- Innocent spouse / injured spouse: joint-return problems, not “I didn’t earn it.”
- Chapter 7 or 13: income tax can be dischargeable if the return was timely, the tax is old enough, and it is not trust-fund. This is attorney work. A resolution firm that skips the bankruptcy analysis is incomplete, not conservative.
Fresh Start is not a secret program
The IRS Fresh Start changes from the early 2010s raised streamlined IA and OIC thresholds. There is no separate 2026 “Fresh Start application.” If a website treats it as a limited-time amnesty, that is a sales script.
How we choose
Transcripts first. Then: can you full-pay inside 6 months? If not, can you full-pay inside 72 months without liquidating the house? If not, is CNC or OIC supportable on Collection Financial Standards? If the answer is OIC, we run the pre-qualifier before anyone pays for a Form 656 package.
